  1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the website greentreetours.in and the tour, travel, and transportation services offered by Green Tree Tours and Travels, established in 2010 and headquartered near Cochin International Airport, Piraroor, Puthussery, Nedumbassery, Kalady, Kerala – 683574.

 

By accessing our website, making a booking, or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

  1. Definitions
  • “Company” refers to Green Tree Tours & Travels, its employees, agents, and affiliates.
  • “Client” or “You” refers to the individual or entity making a booking or using our services.
  • “Services” means all travel packages, cab hire, vehicle rentals, guided tours, and transportation services offered by the Company.
  • “Booking” means a confirmed reservation of any Service made through our website, phone, or in-person.
  1. Booking and Confirmation

3.1 Making a Booking

Bookings can be made via our website inquiry form, WhatsApp, email, or by visiting our office. All bookings are subject to availability and confirmation by the Company.

3.2 Booking Confirmation

A booking is only confirmed upon receipt of a written confirmation from us (via email, WhatsApp, or official receipt) and payment of the required advance/deposit amount. An unconfirmed inquiry does not constitute a booking.

3.3 Accuracy of Information

You are responsible for ensuring all details provided at the time of booking (names, travel dates, pick-up/drop locations, number of passengers) are accurate. The Company is not liable for errors arising from incorrect information provided by the Client.

  1. Payment Terms

4.1 Pricing

All prices quoted are in Indian Rupees (INR) unless otherwise stated. Prices are subject to change without notice until a booking is confirmed. Confirmed bookings are protected from price increases.

4.2 Advance Payment

Depending on the service, an advance payment of 25%–50% of the total amount may be required to confirm a booking. The balance is payable as per the schedule agreed at the time of booking.

4.3 Accepted Payment Methods

  • Bank transfer / NEFT / RTGS
  • UPI (PhonePe, Google Pay, Paytm, etc.)
  • Cash (at our office or to authorised drivers, as applicable)
  • Other methods as notified on our website

4.4 Taxes

Applicable Goods and Services Tax (GST) and other statutory levies will be charged as per prevailing rates. Tax invoices will be provided upon request.

  1. Cancellation and Refund Policy

5.1 Cancellation by the Client

Cancellation charges apply as follows (calculated on the total booking amount):

  • More than 30 days before travel: 10% cancellation fee
  • 15–30 days before travel: 25% cancellation fee
  • 7–14 days before travel: 50% cancellation fee
  • Less than 7 days before travel: 75% cancellation fee
  • Less than 48 hours / No-show: 100% (no refund)

 

Cancellations must be communicated in writing via email or WhatsApp to be valid. Verbal cancellations are not accepted.

5.2 Cancellation by the Company

In exceptional circumstances (natural disasters, political unrest, vehicle breakdown beyond repair, force majeure events), we reserve the right to cancel a booking. In such cases, a full refund of advance paid will be processed within 7–10 business days. We shall not be liable for any additional costs, losses, or expenses incurred by the Client.

5.3 Refund Processing

Approved refunds will be credited to the original payment source within 7–14 business days. Processing timelines may vary depending on your bank or payment provider.

  1. Changes and Amendments

Requests to change travel dates, vehicle type, or itinerary must be made at least 7 days in advance and are subject to availability and any applicable difference in pricing. Changes made within 7 days of travel may attract an amendment fee.

  1. Vehicle and Transportation Services

7.1 Vehicle Fleet

Green Tree Tours & Travels operates a diverse fleet including sedans, multi-utility vehicles (SUVs), and premium mini coaches. The Company reserves the right to substitute a booked vehicle with one of equal or superior category in case of unavailability due to mechanical issues or other operational reasons.

7.2 Driver Conduct

All drivers employed by us are licensed, background-verified, and trained in customer service. Any grievance regarding driver conduct must be reported to us within 24 hours of the journey.

7.3 Luggage and Belongings

The Company is not responsible for any loss, theft, or damage to personal belongings, luggage, or valuables left in our vehicles. Clients are advised to carry valuables with them at all times.

7.4 Waiting and Detention Charges

Waiting charges will be applied after a grace period of 15–30 minutes (as agreed at the time of booking). Extended delays at pick-up points or during the journey may attract additional detention charges.

7.5 Prohibited Conduct

The following are strictly prohibited in our vehicles:

  • Smoking, consumption of alcohol, or use of illegal substances
  • Carrying hazardous materials or explosives
  • Disrespectful, abusive, or threatening behaviour towards drivers or staff
  • Any activity that violates applicable law

 

The Company reserves the right to terminate a journey immediately for violation of these rules without refund.

  1. Tour Packages

8.1 Inclusions and Exclusions

The specific inclusions and exclusions of each tour package are detailed in the package itinerary provided at the time of booking. Unless explicitly stated, tour packages do not include airfare, personal travel insurance, meals beyond those specified, tips and gratuities, or expenses of a personal nature.

8.2 Itinerary Changes

Itineraries are planned in advance, but the Company reserves the right to modify the itinerary (including substituting destinations or activities) due to weather conditions, road closures, government restrictions, or force majeure events. Reasonable alternatives of equal value will be offered wherever possible.

8.3 Third-Party Services

Some components of our packages (accommodation, boat rides, guided tours) may be provided by third-party vendors. While we partner only with reputable service providers, the Company is not liable for the quality, safety, or performance of third-party services.

  1. Client Responsibilities
  • Clients must carry valid identity documents (Aadhaar card, passport, etc.) during all tours and journeys.
  • Clients must arrive at the designated pick-up point on time. Delays caused by the client do not entitle the client to a refund for missed itinerary components.
  • Clients must follow instructions provided by the driver or tour guide for their safety and the safety of others.
  • Clients are responsible for ensuring all members of their travel group (including minors) comply with these Terms.
  • Clients with pre-existing medical conditions, disabilities, or special requirements must inform us at the time of booking so appropriate arrangements can be made.
  1. Liability and Indemnification

10.1 Limitation of Liability

To the maximum extent permitted by applicable law, Green Tree Tours & Travels shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of enjoyment, profit, or opportunity arising from our services
  • Delays or cancellations caused by traffic, weather, strikes, or other factors beyond our control
  • Personal injury, death, or property damage caused by the negligence of third-party service providers

10.2 Force Majeure

The Company shall not be held responsible for any failure to perform its obligations where such failure results from events beyond our reasonable control, including but not limited to: natural disasters, epidemics, government orders, civil unrest, road blockades, or acts of God.

10.3 Indemnification

You agree to indemnify and hold harmless Green Tree Tours & Travels, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, misuse of our services, or any unlawful conduct.

  1. Travel Insurance

The Company strongly recommends that all clients obtain comprehensive travel insurance prior to travel, covering trip cancellation, medical emergencies, personal accident, and baggage loss. The Company does not provide travel insurance as part of its services unless explicitly stated.

  1. Intellectual Property

All content on greentreetours.in, including text, images, logos, graphics, and design, is the intellectual property of Green Tree Tours & Travels and is protected under applicable copyright laws. Reproduction, distribution, or use of our content without prior written consent is strictly prohibited.

  1. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy (available on our website) to understand our data practices.

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall first be attempted to be resolved through mutual negotiation.

 

If resolution is not achieved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India. The Company may also seek injunctive relief in any court of competent jurisdiction.

  1. Amendments to Terms

Green Tree Tours & Travels reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services after the updated Terms are posted constitutes acceptance of the revised Terms.

  1. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
